My Luke ROTJ hero sabers are being recast by 89 sabers

There's two different things here being argued. IP issues, and ethical issues.

When it comes to actual IP-- every person is in violation. The concept of lightsabers belongs to Star Wars. You can't exactly trademark a concept, so Disney can't go around slapping an C&D on anyone using the term lightsaber, or portraying/making something similar. The actual designs of the lightsabers... that's sticky territory. Can you control the likeness rights of a prop? I don't know. Some people say Lucasfilm owned Mark Hamil's face. I don't know if that's true or not. If somebody bootlegged/recast an actual Lucasfilm produced/licensed lightsaber replica, they might be a good target.

Lightsaber replicas exist in a very fine gray area. There's a reason Roman made replicas of camera flashes made by defunct companies, or replicas of old grenades and tap handles as opposed to lightsabers. Point being, every replica maker out there is technically pushing it in this gray area of making something that conceptually doesn't belong to them. It's not super enforce-able, apparently even of you have Disney dollars, so we continue to exist.

The second issue, the ethical one, is what the problem is here, and it's actually a very simple one. Because the IP is as confusing as it is, and we operate in this gray area, no replica maker has any recourse to legally going after another one because no one has the rights. This is why we have to rely on respectful gentleman's agreements.

What people like Anakin Starkiller and BRRogers and khal1993 DO have, is their talent and their time. When somebody makes heavy investments into those things, you have to respect that, and most of us do. That's why we (mostly) are very supportive and willing to pay the prices we do for custom work and craftsmanship.

It becomes an ethical issue when somebody profits off that time and talent by recasting, copying, or otherwise bootlegging that work for themselves. Yes, the general masses may not care and simple want what is available and cheapest, but that's why we have to have these conversations-- so people know and respect how most people in the community choose to work and behave.

I personally never purchased from 89 sabers because from the start people commented on their awful customer service. Saberforge got the same treatment from me. Even when I was DYING for replica saber parts and TGS showed up with some of their offerings, I decided not to support them given that their marketing angle was to simply bash Romans Empire and roygilsing. It is VERY clear in the lightsaber communities which makers/sellers are doing this out of love and who is doing it to make a quick buck. I highly recommend you all stick to supporting those guys doing it with passion (who still need to make money btw), as opposed to those making knock offs to get their hands on your cash.
 
Also, supporting/shilling for recasters on this site can get you banned. So there’s that. ;) Wonder if the mods have been pointed to the accounts for members who run the sites selling the recast items…. because shilling is listed in the code of conduct as a bannable offense (not Khal, that’s been handled).
 
This also happened to me back in the beginning days 1999-2006 or so with my Luke ROTJ Hero and Stunt saber versions as well as my Yoda TPM version saber. While I was being hit with C&D's from both LFL and Fleebay at the time (even renaming to "large man in cape with flashlight", and "small green man with flash weapon" lol) for using "even a perceived" likeness, there were a few people resin casting (recasting?) my metal props and selling them. So yeah, it was a real tough time back in the day. The only time I got upset or tried to stop (wihich was to call them out in the forums) the copiers is when they tried to sell saying their sabers were made by me, or sometimes if they took credit for the design. Which back then the details were not all that accurate as they are today, so for me some 20 plus years later it's all a mute point. But seeing this thread just reminded me of the old days...
 
Just FYI this kind of stuff just doesn't happen in the prop world.

I'm in the firearms industry (writer) and Chinese companies are notorious for copying and selling their own versions of firearms accessories. I'm talking things like red dot sights, scopes, lights, lasers, etc.

If you to the big firearms industry trade show, the SHOT Show, you'll find Chinese reps from these companies photographing and even measuring new products. They usually get "Media" passes as regular show goers are not supposed to shoot photos on the floor.

Then you get the U.S. companies who outsource a new product to China. Give it a year or so and the very company they hired to produce the item will be making and selling a bootleg version using all the tech details from their run.
 
On the subject of helping new members find ethically correct replicas to purchase: one problem I, personally, have faced when trying to buy from a reputable buyer here is figuring out how the heck to find them! There's a lot of people who reference makers by first names and the parts run forum is pretty chaotic. I don't have a practical suggestion for improvement... but there's been more than one time when, in my attempt to figure out who was actually making the kit or part I ended up having to Google it. This, of course, tends to also bring up all the less scrupulous sites as well.

I'm proud to say that my main reaction has been to just give up - I have 10 things I want for every dollar I have, so when I run into that sort of problem here I just go "screw it" and buy a Transformer or whatnot instead of trying to sort out who is a legit maker, who's a recaster, and who is just a scam. But both the book industry and the music industry figured out some time ago that the best way to prevent piracy is to make it easy to buy the legit item. (It doesn't have to be cheaper, just simple.) Obviously there's a limit to how much effort folks here can spare for that... but if anyone comes up with a way to make it quick and easy to identify who the trusted makers are and where one purchases their work, I suspect that would help reduce the number of recasts being sold.

Just putting the idea out there for folks to mull over!

I know that must be frustrating. You have an excellent point. Maybe we should make a master thread of the current makers? Sort of a one stop place of who makes what... although , since the RPF is such a huge diverse forum of many franchises... that list would be quite long and would require constant updating....

I know it's been quite a few years, but it looks like 89 brought back their Luke Hero sabers, this time with a new variant that resembles the V1 a little more: 89sabers

By sight alone, it still just looks like an AS Recast. Any thoughts?

Considering they’re selling with CCSabers it may have been the 89 combined with the ELF.
It kinda seems like they hybridized it (looks like Dave’s 2nd batch grenade from the ELF Sabers recast that Carl Chen provided)
