I'll most likely get some flak from posting this,but I really don't care,as I'm an artist,and I don't want other people stealing my original work!
I know that recasting is wrong on all levels for any reason,so I'll just post this as my personal stance on this subject:
If you're not a licensed studio,or licensee,there's nothing you can do to keep other people from recasting your work legally. There's no right way to do something wrong. When you're part of a community like this,you're very lucky to have other people look out for you! When you're an artist as I am - you don't want your hard work ripped off by anyone no matter what their excuse is. There are forums similar to this one that don't care if someone recasts your work,as most of their members are not licensed vendors.
Look at is this way:
I abide by the rules of the community that I'm a member of. If they get a Cease & Desist order from a licensed company because their members are recasting,or recreating their legally made product,then everyone will look down on you,and give you a black mark. This will keep the community from wanting anything to do with you! When a company no longer makes a product - that doesn't neccessarily mean that it's not still licensed,or illegal to make. This just means that it's no longer available from them.
For reasons unknown to the public some companies will change licensees,usually for quality control issues. But the members here know the legal ramifications for doing it,when they recast a known item that is no longer produced by a company. This doesn't mean that the license has expired,or that the patent on it has either. This only means that it's not in production. The original copyrights owner still owns those rights legally,but you risk that when you recast anyones' work at any time.
When you make an item that doesn't have any of these legal securities,there isn't a lot you can do about it. We respect each other here to not to the same,but this is why there are rules so that the original artist will make money doing this,even if it is illegal. Recasting another members' work or a known item that was produced is still recasting,no matter what anyone says. I don't approve of recasting manufactured items myself,as the original artist,and the company that commsioned him to do it in the first place won't see a single dime of the money all these pirates make stealing their original work. = NO HONOUR AMONG THIEVES is the original saying.

Mercanaries is more of the description of these people on these forums who recast other peoples' items. I know that recasting out of production items is allowed here,as it's a commonly accepted practice. So I can't defend my own personal beliefs against it. I can only defend what others here bring to the table that they made with their own hands.
